  1. About our Review Policy
    1. Our Review Policy (our Review Policy) governs the ratings or reviews (Reviews) you submit to BAT (New Zealand) Limited (BATNZ, we, our, or us) on one or more of our products (Products).
    2. By submitting a Review on our Products, you agree to and accept this Review Policy (as well as our Privacy Policy and our Website Terms).
    3. Please make sure you have read this Review Policy, our Privacy Policy, and our Website Terms carefully before submitting a Review.
    4. We may amend this Review Policy from time to time by publishing an updated Review Policy on one or more of our websites including batnz.com; vuse.co.nz; vusionry.co.nz (collectively our Website). Any changes will apply to any Reviews on or after the date on which the changes to our Review Policy are published. Your continued use of our Website following these changes constitutes acceptance of our Review Policy. You should review our Review Policy regularly to ensure you understand the terms and conditions that apply to you each time you provide a Review.

  3. What can you provide a Review on?Reviews can be provided on any Products.

  4. Who can provide a Review?To submit a Review, you must:
      1. be a registered user (with a registered account) on our Website, and therefore an adult smoker or vaper (and at least 18 years old); and
      2. have actually used the Product you are reviewing as it is intended to be used.
  5. What Review guidelines must you follow?
    1. The content of all Reviews must:
      1. be directly related to a Product you have used;
      2. include Rating (out of five stars) and a Review (in English language);
      3. be made in good faith, original and truthful.
    2. Reviews must not:
      1. be related to delivery issues experienced as a result of third party couriers, availability issues, customer service issues, or careers with us;
      2. be false, misleading, inaccurate, harmful, or spread misinformation;
      3. be intended for improper or unlawful purposes;
      4. be insulting, abusive, obscene, discriminatory, defamatory, derogatory, or misogynistic;
      5. likely to upset, embarrass, alarm, or annoy any other person;
      6. contain profanities, threatening language, URL links, gifs, pictures, videos, phone numbers, explicit content, advertising, personal (or identifying) information, names of other companies, names of websites, viruses or other potentially damaging computer programs or files, or content that you have been paid (or that we believe you have been paid) to submit;
      7. infringe any third party's copyright, patent, trademark, trade secret, or other proprietary right or rights (including of publicity or privacy); or
      8. violate any laws or regulations or otherwise be inappropriate as reasonably determined by BATNZ.
  6. What are our publishing guidelines for Reviews we receive?
    1. We will not edit Reviews.
    2. We will group Reviews based on the Product that has been reviewed.
    3. Where we introduce a new version of a Product to our Website, we may from time to time choose to attach Reviews of the previous version of the Product to the newer version of the Product.  In such a case, a disclaimer will be attached to the Review to identify where it was left in relation to a previous version of the Product. 
    4. We (or our third party review service) will moderate and/or screen Reviews to ensure that they meet the requirements of this Review Policy, particularly our Review guidelines set out in clause 5. Reviews that do not, will not be published.
    5. If you see a Review that does not meet the terms of this Review Policy, please let us know.
  7. About the third party review service we useWe use Yotpo Inc (Yotpo) to help us collect, moderate, and/or screen Reviews. Any Review you make:
      1. may be used to generate logs, data, and learnings; and
      2. will be subject to Yotpo’s terms of services, available at: https://www.yotpo.com/terms-of-service/.
  8. Other important termsBy submitting a Review, you:
      1. allow us to use your Review in any manner without any obligation or compensation to you;
      2. understand you are participating in a public forum and that your Review will be available to others;
      3. agree to Yotpo’s terms of services;
      4. agree to indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), harmless from all claims, demands, costs and damages of every kind and nature, known and unknown including legal fees, arising out of a breach of this Review Policy, or your violation of any laws or regulations or the rights of any third party; and
      5. grant us a perpetual, irrevocable, royalty-free, transferable, and sub-licensable right and license to use, copy, delete in its entirety, publish, translate, create derivative works from, and/or sell and/or distribute a Review and/or incorporate a Review into any form, medium or technology throughout the world without compensation to you or anyone else (and agree that this license will survive the termination of this Review Policy or your use of our Website).
