GIVE AND GET TERMS AND CONDITIONS

1. Details for this Promotion

1.1 The Give and Get Programme is operated by BAT (New Zealand) Limited (BATNZ, we, our, or us) through its website including batnz.com; vuse.co.nz; vusionry.co.nz as well as any applicable redirected website (collectively our Website);

1.2 Each existing Vuse customer has the opportunity to participate in the Give and Get Programme. Existing Vuse customers may log into their account, visit and receive a unique URL that they can use for sharing with friends and family, to help them make the switch to Vuse.

1.3 Each referred friend (must not be an existing Vuse member) who clicks on the referral link and shares their email address with us will then receive a referral code (sent or displayed to them on screen).  This referral code will allow them to claim (1) free Vuse Go Reload Ready to Vape Kit and $15 off their first order when the referred friend purchases at least $30 worth of Vuse products on vuse.co.nz. 

1.4 For every unique code redemption by a referred friend, the original referring Vuse customer will each receive a discount code (sent to them by the Promoter) for a $15 discount, which can be redeemed when purchasing at least $30 worth of Vuse products through on vuse.co.nz.

1.5 For the avoidance of doubt, a friend can only be referred (and receive a referral code) once.

1.6 Eligible participants: An eligible participant is one person/individual (where each person/individual cannot create multiple accounts or email addresses on our Website in order to either enter this programme more than once). 

(a) All eligible participants must

(i) be an existing smoker or vaper;

(ii) be a New Zealand resident;

(iii) be aged 18 years and over; and 

(iv) adhere to these Give and Get Terms and Conditions as well as our Terms and Conditions of Sale.

1.7 BATNZ employees or associated parties (and their immediate families - being their spouse, child or parent) and existing retailers of Vuse products (including their associated companies and their immediate families - being their spouse, child or parent), are not eligible participants and therefore not able to enter the Give and Get Programme.

2. Varying these Terms and Conditions

2.1 BATNZ reserves the right to vary these Give and Get Terms and Conditions without notice, to modify, reschedule or terminate the Give and Get Programme.

2.2 In the event that any changes are made to our Give and Get Terms and Conditions, and these changes have been reasonably communicated through our Website, or any other means of communication, your continued use of our Website following these changes constitutes acceptance of our Give and Get Terms and Conditions.

3. BATNZ’s decisions and rights

BATNZ’s decision on all matters relating to this Programme is final and binding and no correspondence will be entered into, except as otherwise stated in these Give and Get Terms and Conditions. Failure by BATNZ to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Privacy

These Give and Get Terms and Conditions are deemed to incorporate BATNZ’s Privacy Policy and by participating in the Give and Get Programme, a participant accepts the terms and conditions of that Privacy Policy.

 

5. Collection and use of personal information

5.1. To the extent that BATNZ collects personal information to conduct the Give and Get Programme it can, for this purpose, disclose such information to third parties, including, but not limited to regulatory authorities, or use such information to contact the participant about the Give and Get Programme. Any entry in the Give and Get Programme is conditional on providing this information. By participating in the Give and Get Programme an eligible participant:

(a) grants BATNZ the right to use their name, character, photographs or likeness in connection with the Give and Get Programme and for future programmes and marketing purposes (and waives any claims to royalty, right or remuneration for such use);

(b) agrees to provide BATNZ with a perpetual royalty-free license to use their username in any way including, but not limited, to: 

(i) the Vuse New Zealand Facebook Group page (at https://www.facebook.com/groups/vusenz/);

(ii) the Vuse New Zealand Instagram page (at www.instagram.com/vuse.newzealand); and

(iii) BATNZ’s other social media platforms and websites.

5.2. Each participant of the Give and Get Programme understands that they have the right to access, and may request correction of, any of their personal information held by BATNZ by contacting us at info.nz@vuse.com. All claims become the property of BATNZ.

6. Governing law

These Give and Get Terms and Conditions are governed by, and interpreted in accordance with, New Zealand law. We both agree to submit to the exclusive jurisdiction of the courts of New Zealand.
