  1. About the Vuse+ Loyalty Programme
    1. These Loyalty T&Cs govern:
      1. the operation of our Vuse+ Loyalty Programme (“Loyalty Programme”);
      2. the use of the My Vuse+ section of BAT (New Zealand) Limited’s (BATNZ, we, our, or us) website including batnz.com; vuse.co.nz; vusionry.co.nz as well as any applicable redirected Website (collectively our Website); and
      3. any promotional activity and loyalty transactions that arise as a consequence of our Loyalty Programme.
    2. Participants, or prospective participants, in our Loyalty Programme should read these Loyalty T&Cs carefully and make sure they understand them before joining our Loyalty Programme.
    3. By participating in our Loyalty Programme, a Member (as defined below) agrees that they have read, understood and are legally bound by:
      1. these Loyalty T&Cs;
      2. our Terms and Conditions of Sale; and
      3. our Privacy Policy.
    4. All participants in our Loyalty Programme consent to us sending them emails in relation to our Loyalty Programme and the promotion and marketing of our goods, unless opted out.
    5. We may amend these Loyalty T&Cs at any time (including retrospectively) without prior notice in our absolute and sole discretion. Any amendments will be posted on this page.
    6. In the event that any changes are made to our Loyalty T&Cs, and these changes have been reasonably communicated through our Website, or any other means of communication, your continued use of our Website following these changes constitutes acceptance of our Loyalty T&Cs.
  2. Membership
    1. Our Loyalty Programme is for existing smokers and/or vapers who are at least 18 years of age or older.
    2. Membership of our Loyalty Programme is free. An individual (not organisations or groups) will automatically become a member (“Member”) of our Loyalty Programme when they create an account by signing up on our Website
    3. A Member must be a legal resident of New Zealand with a valid email address.
    4. At any time, a Member can only have one membership of our Loyalty Programme and only one account may be associated with a valid single email address.
    5. We reserve the right to refuse, terminate, modify or suspend membership of our Loyalty Programme at any time without prior notice or reason and in our absolute and sole discretion. If we suspect fraud, misrepresentation, abuse, or violation of these Loyalty T&Cs, we also have the right to take appropriate legal action.
    6. Membership of our Loyalty Programme is not transferable.
    7. A Member:
      1. will be required to provide their full name, mailing address, email address, and date of birth and to create a password in order to create an account; and
      2. is solely responsible for maintaining the accuracy and privacy of their account information and for updating it as required.
    8. If a Member believes their account has been compromised, they agree to immediately contact the Vuse Care Team at info.nz@vuse.com.
    9. We reserve the right at any time to:
      1. limit the number of participants in our Loyalty Programme; or
      2. change our Loyalty Programme Coupons (each a “Coupon”).
    10. A Member can at any time terminate their membership by providing written notice to our Vuse Care Team at info.nz@vuse.com. The email must specify the Member’s name, address, phone number, and email address associated with the Account, and confirm that the Member wishes to be removed from our Loyalty Programme. It may take up to seven (7) business days for the cancellation to complete. The Member acknowledges and agrees that, upon cancellation of their membership, they will forfeit any Vuse+ Points (“Vuse+ Points”) they may have earned and/or any Coupons that might otherwise have been available during their continued participation in our Loyalty Programme. If a Member wishes to return to our Loyalty Programme after cancelling their membership, they will be required to join our Loyalty Programme again starting with no Vuse+ Points or available Coupons.
    11. We may terminate or suspend a Member’s membership at any time and, in our sole discretion, by giving reasonable notice in writing. If we decide to discontinue the Loyalty Programme we may terminate a Member’s membership by giving you reasonable written notice.
    12. If we terminate our Loyalty Programme or if a Member’s membership is revoked, any Vuse+ Points or Coupons in a Member’s account or available to a Member prior to such termination or revocation will automatically expire with no compensation payable, and a Member’s access to our Loyalty Programme and its features will automatically terminate.
    13. A Member or former Member may still receive emails, including marketing emails, from us relating to their account or pursuant to their subscription, unless opted out. 
  3. Participation
    1.  Our Loyalty Programme is a way in which we reward and thank our loyal customers for purchasing Vuse products and/or taking other Loyalty Programme-related actions. A Member may:
      1. purchase promotional code discounts (Coupons) by spending Vuse+ Points;
      2. earn Vuse+ Points for each dollar a Member spends on eligible purchases online at www.vuse.co.nz, excluding other discounts, or any other Coupons.
    2. We may, in our absolute and sole discretion, provide additional Vuse+ Points in connection with certain transactions and promotions. For an eligible purchase or action to qualify for Vuse+ Points, a Member must:
      1. be enrolled in our Loyalty Programme; and
      2. must be logged into their account prior to making such purchase or taking such action.
    3. Vuse+ Points and Coupons earned through our Loyalty Programme, are non-negotiable and cannot be redeemed either in whole or in part for cash.
    4. Only the Member paying for products in a qualifying purchase may accumulate Vuse+ Points. The purchase of any Subscription Product is not a qualifying purchase and will not result in the Member earning any Vuse+ Points.
    5. If a Member returns items from a qualifying purchase or obtains Vuse+ Points through fraudulent or other activity that violates these Loyalty T&Cs, the appropriate number of Vuse+ Points originally earned from such purchase or activity will be automatically deducted from the Member’s account balance.
    6. Vuse+ Points and Coupons do not constitute property of any Member or any other person and may not be gifted, sold, or otherwise transferred, other than by Vuse or as otherwise expressly provided for in these Loyalty T&Cs, and any receipt or use of Vuse+ Points or Coupons in violation of these Loyalty T&Cs will render such Vuse+ Points or Coupons void.
    7. Member accounts, Vuse+ Points, or Coupons may not be shared or combined.
    8. Vuse+ Points earned may not be eligible for redemption until 24 (twenty-four) hours after they are awarded.
    9. Vuse+ Points will expire six (6) months after they are earned. The expiry date for each Vuse+ Point will be specified in a Member’s account. We reserve the right in our absolute and sole discretion to change the expiry date for Vuse+ Points at any time without prior notice.
    10. If a Member has concerns that a purchase or other action was not properly applied to their account, they should contact our Vuse Care Team at  info.nz@vuse.com. The email must specify the Member’s name, address, phone number, and email address associated with their account, the date of the purchase or action, and the issue(s) they encountered. This email must be sent within 45 (forty-five) days after the purchase or action took place. We are not responsible for late notifications regarding purchases or actions not being credited to a Member’s account.
    11. A Member may purchase Coupons using Vuse+ Points by signing into their associated account. Coupons may only be purchased online through our Website.
  4. Collecting and using Vuse+ Points
    1. Vuse+ Points will be accumulated and stored on a Member’s account. Members can view their Vuse+ Points balance at any time by logging into their account.
    2. For every one (1) New Zealand Dollar (NZD) spent on any products at www.vuse.co.nz (including GST and shipping costs), a Member will receive 10 Vuse+ Points. Where the total order does not amount to an exact rounded dollar (i.e. $19.90), amounts will be rounded down for the purposes of earning Vuse+ Points (i.e. $19.90 will result in one hundred and ninety (190) Vuse+ Points being earned).
    3. Vuse+ Points cannot be earned on retrospective purchases.
    4. One-off, annual, or special Vuse+ Points or credits applied to an account will also be awarded in the following cases:
      1. 500 (five hundred) Vuse+ Points on signing-up (one-off);
      2. 500 (five hundred) Vuse+ Points if a Member follows @vuse.newzealand on Instagram (one-off);
      3. 500 (five hundred) Vuse+ Points if a Member joins our Facebook Group https://www.facebook.com/groups/vusenz (one-off); and
      4. 250 (two hundred and fifty) Vuse+ Points if a Member leaves a review at www.vuse.co.nz (maximum 10 reviews)
      5. 1000 (one thousand) Vuse+ points if a Member returns their Vuse pods or devices as part of our RePOD Programme.
  5. Purchasing Coupons
    1. Members have the choice to purchase either cash Coupons or discount Coupons by using their Vuse+ Points which they can then apply against their order.
    2. For cash Coupons, Members can purchase a $1 NZD Coupon for every 100 Vuse+ Points spent. For example:

    4. Members will have the ability to decide how many Vuse+ Points they would like to use when purchasing a single cash Coupon at the checkout.
    5. Once purchased, cash Coupons will be automatically applied at the checkout for that cash Coupon to be applied against the order. Discount Coupons will have a unique code which the Member will need to input at the checkout for that discount Coupon to be applied against the order.
  6. Limitation of liability 
    1. We or our parent company, subsidiaries, affiliates, directors, employees, agents, partners, licensors, contractors, contractual partners, telecommunication providers, content providers, and assignees and their respective officers, directors, employees and agents will not be responsible for or liable for any loss or damage, however caused, in connection with our Loyalty Programme or a Member’s participation in it (in contract, tort (including negligence) or otherwise) for any (but not limited to):
      1. any cost (including tax liability) associated with accessing any website in relation to our Loyalty Programme, including that incurred in the provision of Coupons or Vuse+ Points;
      2. access delays or access interruptions to our Loyalty Programme;
      3. data non-delivery, loss, theft, mis delivery, corruption, destruction, or unauthorised access to a Member’s account or a Member’s Vuse+ Points;
      4. loss or damages of any sort incurred as a result of dealing with or the presence of any third-party links on our Loyalty Programme site or on our Website or use of any Coupons of our Loyalty Programme;
      5. computer viruses, system failures, technical issues or malfunctions which may occur in connection with a Member’s use of our Loyalty Programme site or our Website, including hyperlinks to or from third-party websites;
      6. any inaccuracies or omissions in our Loyalty Programme content or adverse consequences arising out of use or reliance on such information or content;
      7. any claim arising out of or in connection with the termination of our Loyalty Programme;
      8. any loss of profit (direct or indirect) or any direct, consequential, incidental or indirect loss or damage resulting from any breach of these Loyalty T&Cs; or
      9. events beyond our reasonable control, including without limitation any act of God, act of war, natural disaster, cyberattacks, terrorism, or any act or omission of a third party.
    2. To the extent we or our parent company, subsidiaries, affiliates, directors, employees, agents, partners, licensors, contractors, contractual partners, telecommunication providers, content providers, and assignees and their respective officers, directors, employees and agents remains liable to Members, its aggregate liability (in contract, tort (including negligence) or otherwise) in respect of any one event or related series of events under these Loyalty T&Cs is limited to the monetary value equivalent of the Coupons or Vuse+ Points in a Members account at the time of the event, or first event in the series, which gives rise to the liability.
    3. These Loyalty T&Cs are to be read in conjunction with any additional conditions associated with specific promotions, as well as in conjunction with our Terms and Conditions of Sale. In the event of any inconsistencies, our decision as to which terms prevail will be final and binding.
    4. Our decision in relation to all matters arising in relation to our Loyalty Programme is final and binding.
  7. IndemnificationEach Member agrees to defend, indemnify and hold harmless us, our parent company, subsidiaries, affiliates, directors, employees, agents, partners, licensors, contractors, contractual partners, telecommunication providers, content providers, and assignees and their respective officers, directors, employees and agents from and against any and all liabilities, claims, actions, demands, damages, costs, losses and expenses (including reasonable legal fees) made by any third party due to or arising out of a Member’s participation in our Loyalty Programme in violation of any law, rule, regulation, guideline, or these Loyalty T&Cs, and/or a Member’s violation of any rights of another.
  8. Law and dispute resolution
    1. Our Loyalty Programme and these Loyalty T&Cs are governed by the laws of New Zealand.
    2. Each Member consents to the exclusive jurisdiction and venue of the Courts within New Zealand, for any claims arising out of or relating to our Loyalty Programme or their participation in our Loyalty Programme.
  9. Privacy The personal information collected from a Member in connection with our Loyalty Programme, including but not limited to their membership registration data or purchases made in connection with their membership, is subject to our Privacy Policy.
